In Holding and Psychoanalysis: A Relational Perspective, Joyce Slochower brings a contemporary relational framework to bear on Winnicott's notion of the analytic holding environment. She presents a fresh, thought-provoking, and clinically useful integration of Winnicott's seminal insights with contemporary relational and feminist/psychoanalytic contributions. Seeking to broaden the concept of holding beyond work with severely regressed patients, she addresses holding in a variety of clinical contexts and focuses especially on holding processes in relation to issues of dependence, self-involvement, and hate. (...) She also considers clinical work with patients "on the edge" - patients who seem deperately to need a holding experience that remains paradoxically elusive. Slochower begins her study by questioning the therapeutic limitations of an interactive style. There are times, she proposes, when certain patients simply cannot tolerate evidence of the analyst's separate subjective presence and instead need a holding experience. Though this holding function is essential to work with difficult patients, it enters into the treatment of all patients, whether as figure or ground. Slochower's relational understanding of holding leads her to consider the impact of holding on patient and analyst alike. Throughout, she emphasizes the analyst's and the patient's co-construction, during moments of holding, of an essential illusion of analytic attunement; this illusion serves to protect the patient from potentially disruptive aspects of the analyst's subjective presence. Slochower's case vignettes helpfully illuminate the intersubjective aspects of the holding process, including the clinical picture when a holding frame fails. She elaborates her thesis by considering the therapeutic function of holding in mourning. And she concludes her study with a cogent examination of the theoretical and clinical limitations of working with a holding process. A welcome reprise on an essential Winnicottian theme, Holding and Psychoanalysis broadens and deepens our understanding of the therapeutic role of the analyst's holding function. (shrink)

Aboriginal Australians have traditionally enjoyed little protection from the law. The matter of land has been at the heart of white settler/Aboriginal relations since the nation was first founded. It is only recently that recognition has been given to the land rights of Australian indigenous people. This recognition was finally made at the property law level in 1992 through the High Court decision in Mabo v. Queensland (n. 2) ([1992] 175 CLR 1). The 1993 High Court decision in The Wik (...) Peoples v. Queensland ([1996] 71 ALJR 173) reinforced that recognition. It did so through the principle that pastoral lessees' and native title holders' rights might co‐exist except that, in the event of any inconsistency, the pastoralists' rights were to prevail, provided pastoral activity was being pursued. The most recent legal change is the parliamentary revision of the Native Title Act so that the Wik co‐existence principle was put to rest, mainly through permitting the State governments to upgrade pastoral holdings to a form of freehold, thus immunising them from native title claims, and minimising the payment of compensation. In this paper we argue that the country must consider what has been lost in this about‐turn from the recognition of native title to land in Mabo. We argue that the nation must consider the emphases in the Mabo judgments upon the significance of international law and the need for the common law not to be locked into a racist past. From that point, we contend for the need to recognise not only native title to land but what lies beyond that: indigenous political and human rights. (shrink)

Background: When adolescent boys experience close, secure relationships with their parents and peers, the implications are potentially far reaching, including lower levels of mental health problems in adolescence and young adulthood. Here we use rare prospective intergenerational data to extend our understanding of the impact of adolescent attachments on subsequent postpartum mental health problems in early fatherhood.Methods: At age 17–18 years, we used an abbreviated Inventory of Parent and Peer Attachment to assess trust, communication, and alienation reported by 270 male (...) participants in their relationships with mothers, fathers, and peers. More than a decade later, we assessed the adult males, now fathers, at 12 months postpartum for symptoms of depression, anxiety, and stress. Logistic regression was used to examine the extent to which attachment dimensions predicted paternal postpartum mental health, adjusting for potential confounding, and with assessment for interactions between parent and peer attachments.Results: Trust in mothers and peers, and good communication with fathers during adolescence, were associated with 5 to 7 percentage point reductions in postpartum mental health symptoms in early fatherhood. Weak evidence of parent-peer interactions suggested secure attachments with either parent or peer may compensate for an insecure attachment with the other.Conclusions: Our results suggest that fostering trust and communication in relationships that adolescent boys have with parents and peers may have substantial effects on rates of paternal postpartum mental health problems. The protective benefits may be preventative in intergenerational cycles of risk for mental health problems. (shrink)

Many male traits are well explained by sexual selection theory as adaptations to mating competition and mate choice, whereas no unifying theory explains traits expressed more in females. Anne Campbell's “staying alive” theory proposed that human females produce stronger self-protective reactions than males to aggressive threats because self-protection tends to have higher fitness value for females than males. We examined whether Campbell's theory has more general applicability by considering whether human females respond with greater self-protectiveness than males to other threats (...) beyond aggression. We searched the literature for physiological, behavioral, and emotional responses to major physical and social threats, and found consistent support for females' responding with greater self-protectiveness than males. Females mount stronger immune responses to many pathogens; experience a lower threshold to detect, and lesser tolerance of, pain; awaken more frequently at night; express greater concern about physically dangerous stimuli; exert more effort to avoid social conflicts; exhibit a personality style more focused on life's dangers; react to threats with greater fear, disgust, and sadness; and develop more threat-based clinical conditions than males. Our findings suggest that in relation to threat, human females have relatively heightened protective reactions compared to males. The pervasiveness of this result across multiple domains suggests that general mechanisms might exist underlying females' unique adaptations. An understanding of such processes would enhance knowledge of female health and well-being. (shrink)

Anne Margaret Baxley offers a systematic interpretation of Kant's theory of virtue, whose most distinctive features have not been properly understood. She explores the rich moral psychology in Kant's later and less widely read works on ethics, and argues that the key to understanding his account of virtue is the concept of autocracy, a form of moral self-government in which reason rules over sensibility. Although certain aspects of Kant's theory bear comparison to more familiar Aristotelian claims about virtue, Baxley (...) contends that its most important aspects combine to produce something different - a distinctively modern, egalitarian conception of virtue which is an important and overlooked alternative to the more traditional Greek views which have dominated contemporary virtue ethics. Brain in a vat scenarios in analytic philosophy feature both brains and technological apparatus. The relation between specimens and technology is an interesting aspect of these scenarios, and in order to explore this relation, I contrast here two kinds of scientific collecting practices: the collection of post-mortem brains versus the compilation of digital brain atlases. This contrast highlights a novel configuration of the relation between brains and new information technologies. This new configuration is traced back to the late 1980s, which (...) saw the rise of a new kind of collection of brains, with a markedly different scope and nature: the neuroscience database. Brains are now easily captured in vivo, so that while post-mortem brains were precious and few, scanners provide an embarrassment of riches in the form of terabytes of data. The rise of the virtual brain as a new digital object for research is reliant on the development of new imaging technologies, but also on the growth of computerised tools, informatics, and electronic networks in this field. These developments contribute to an informational turn in scientific research. This article considers what is involved in the shift in type of object, from the scarce, wet, biological brain to a plentiful, digital, virtual one. It discusses the significance of this new object in terms of collections, institutions, and research practices. (shrink)

In The Logic of Decision Richard Jeffrey defends a version of expected utility theory that advises agents to choose acts with an eye to securing evidence for thinking that desirable results will ensue. Proponents of "causal" decision theory have argued that Jeffrey's account is inadequate because it fails to properly discriminate the causal features of acts from their merely evidential properties. Jeffrey's approach has also been criticized on the grounds that it makes it impossible to extract a unique probability/utility representation (...) from a sufficiently rich system of preferences (given a zero and unit for measuring utility). The existence of these problems should not blind us to the fact that Jeffrey's system has advantages that no other decision theory can match: it can be underwritten by a particularly compelling representation theorem proved by Ethan Bolker; and it has a property called partition invariance that every reasonable theory of rational choice must possess. I shall argue that the non-uniqueness problem can be finessed, and that it is impossible to adequately formulate causal decision theory, or any other, without using Jeffrey's theory as one's basic analysis of rational desire. Moral status, she asserts, is a more complex affair: it comes in degrees and there are a variety of sufficient conditions. The first part of the book (roughly three quarters of it) is devoted to outlining some standard ‘uni-lateral’ accounts, criticising them in so far as (...) they purport to provide necessary and sufficient conditions for status, but selecting the plausible parts of each to come together later in the multi-criterial account. Hans Christian Andersen is a cultural icon, and his fairy tales are famous around the world. But despite the positive ring to this description, his status as a canonized author poses a challenge when he is passed on to new generations of readers. In this article, we show examples of how this challenge reveals itself in Danish primary school teaching where Andersen is an obligatory figure in the subject Danish where he is frequently framed as a national romantic author of (...) morally unambiguous texts. Taking the current use of “The Ugly Duckling” (1844) in primary school teaching materials as a point of departure, we aim to show Andersen’s potential to be presented as an element in primary school teaching that draws on dialogic inquiries rooted in Philosophy with Children. Philosophical inquiries are characterized by an open mindset that incite teachers as well as school children to engage with the rich ethical themes and literary qualities of Andersen’s fairy tales. We conclude the article with our own inquiry manual to “The Ugly Duckling” to illustrate a way to overcome the current hegemonic framing of Andersen and reopen his fairy tale for future discussions and interpretations. This handy organizer of information and rather effective (...) retrieval mechanism has been treated with a fair amount of contempt after being sidelined towards the end of the seventeenth century and then falling into public disrepute, its rich stock of precious commonplaces devalued into the small change of mere banalities. Nor indeed does it suit the agenda of post-Romantic scholars and critics looking in a simplistic way for signs of originality and innovation. However, the last few years have seen commonplaces in their more sophisticated guise back on the critical agenda, with several particular studies and, latterly, two major overviews published in a single year. 1 The thesis underlying this paper is that the commonplace-book is central to an understanding of how knowledge was organized in the early modern period. More than that, the commonplace-book keys us into procedures of investigation and debate and into the dialectical and rhetorical modes of articulating thought which were agreed to have persuasive force; and it exhibits the commonality of expectations, the common places, which ensured a common route into a shared area of communication when the cultural consensus of Western Europe was strained to breaking point.One test of this thesis will be whether it can be usefully applied to texts which fit badly into interpretative frames familiar to the modern reader. The particular purpose of this paper is to apply the principles of commonplace-book [End Page 421] reading to just such an awkward case, in order at least to suggest the possibility of recovering an historically probable reading strategy which may more fully recuperate the text for the modern reader. The Politica of the eminent Stoic philosopher and scholar of antiquity, Justus Lipsius (1547–1606), is a network of quotations from ancient authorities linked together by Lipsius’s own words. He himself regarded it as one of his most important achievements. His contemporaries and their seventeenth-century descendants knew perfectly well how to read it, and there is plenty of evidence that they regarded it highly. 2 Modern readers find it an embarrassment, not knowing quite what to do with a book from which the author eclipses himself, yet keeps a dead hand on it: “All of it is mine and nothing is.” 3 Modern critics tend to assume it is all Lipsius, riding roughshod over the quotation indicators 4 ; or they prefer to think that nothing is and treat the text solely as a compilation of extracts 5 ; or they get tied in knots trying to rescue Lipsius’s voice drowned out in his quotations. 6 But Lipsius’s original readers in 1589 knew how to read it, because he told them: “For what is it but a well-arranged register of accounts or COMMONPLACES?” 7If we are going to get anywhere near the original point of reception, we must remind ourselves about commonplaces and commonplace-books. It was Erasmus in De copia who gave the first systematic guidelines for making commonplace-books, but by the time of Lipsius schoolboys in every Latin school in Northern Europe were busy excerpting from their [End Page 422] texts as they read, either under the schoolmaster’s instructions or at their own discretion. The lead text of this book is based on primatologist Frans de Waal’s 2003 Tanner Lectures at Princeton University, to which he adds three short appendices. There are commentaries by Robert Wright, Christine Korsgaard, Philip Kitcher, and Peter Singer, followed by a 20-page response. Josiah Ober and Stephen Macedo provide a brief introduction. As befits a Tanner lecturer, de Waal’s scope is broad, his writing accessible, and the pace lively. He continues his crusade against the “veneer theory”—the idea that humans (...) are naturally sociopaths and that empathy, altruism, and morality are the result of recent cultural forces. The extent to which de Waal dichotomizes this debate, however, masks much of interest. One can agree with the seemingly obvious fact that humans are obligatorily gregarious organisms—replete with various prosocial mechanisms—while still expressing reasonable doubt that our capacity to make moral judgments is the result of an innate mechanism dedicated to that task. De Waal is an unparalleled source of rich first-hand primatological data, arguing cogently that humans show continuity with other apes regarding empathy, consolation behavior, peacemaking, and reciprocal relations. Yet he admits these “building blocks” are “by no means sufficient” for morality, and in his Response discusses two further levels of morality: rule enforcement for the community’s good, and disinterested moral reasoning. He doesn’t address whether this third, uniquely human, level is a distinct innate adaptation, apparently not appreciating that if it isn’t, and yet is necessary for being literally accorded a “moral sense”, then moral nativism is false and at least some of human morality is “veneer.” In characteristic non-philosopher manner, de Waal ultimately rejects the question as “semantics” and thus “mostly a waste of time”. It seems a surprising blemish that the author of a book subtitled “How Morality Evolved” should grow impatient with those wondering what precisely is necessary and sufficient for morality, and what specifically has evolved. This article represents the outcome of a dialogue between a vet and a healthcare ethicist on the theme of ‘love’ in professional life. We focus on four types or varieties of love in relation to the professional care of humans and animals. We discuss the relevance of Fromm’s core elements of love and consider the implications of these for human and animal health care practice. We present and respond to five arguments that might be waged against embracing love as a (...) professional value in veterinary and medical practice. We argue that a moderated love can and should be reclaimed as a contemporary professional value. It is most helpfully contextualised within virtue ethics or care ethics. We suggest that love is a rich starting point from which to launch an exploration of an interprofessional humanimal clinical ethics. (shrink)

This book collects a multidisciplinary range of contributions focusing on the prolific and seminal work of Willem Drees in the fields of philosophy of religion, philosophy of the humanities, and science and theology/religion. Trained in both theoretical physics and theology/philosophy of religion, Drees holds doctoral degrees in both theology and in philosophy and, amongst other distinguished positions, held professorships at the University of Leiden and at the University of Tilburg. Drees was also Editor-in-Chief of Zygon, Journal of Religion & Science, (...) between 2008 and 2018, and served as President of the European Society for the Study of Science and Theology (ESSSAT) between 2002 and 2008. In 2018, he was elected as member of the Royal Holland Society of Sciences and Humanities (KHMW). This contributed volume builds on Drees’ expansive and provocative scholarly contributions, notably around the concept and meaning of naturalism and the humanities to the fields of science and religion, as exemplified by his works Religion, Science and Naturalism (1996) and What Are the Humanities For? (2021). In a time where more and more young people across the globe are entering higher education such cross-disciplinary explorations and (re-)evaluations are vital to the field. Accordingly, by approaching his work from a variety of disciplines this collection illuminates the broad reach of Drees’ work and provides scholars from various fields with many new and rich opportunities avenues for research. In their world, the neh and the powerful despised the poor and the disadvantaged and took pains to preserve the gulf between them. Inspired by the prophetic denunciation of injustice, Luke cnticized the rich and thus transgressed against Greco-Roman values. Still, Luke's enduring contribution to Christian social ethics is greater than this: Instead of merely condemning the rich, Luke forged a vision of (...) community in which both rich and poor are spiritual equah and the social and economic inequities between them can be vigorously and conscientiously addressed. Science studies scholars of the twenty-first century have been arguing for a reconceptualization of science based on the emergence of new values and practices. Allegedly, these new norms have come from science in the context of application. However, the argument here is that science in the context of application is a phenomenon with as long and rich a history as so-called pure or basic science. Science in the context of application only appears to be new since so little light (...) has been shined on applied science by historians and philosophers of science. This article explores the consequences of reaching back into remote history seeking science in the context of application and finds that doing so helps scholars understand present day developments, as well. Three examples of historical applied science are explored: ancient Roman engineering, Enlightenment-era navigation and surveying, and American early Republic engineering. In addition, the work of I. Bernard Cohen is examined for historiographical evidence of a narrowing account of what counts as science in the post-WWII period. (shrink)

Institutional and political developments since the end of the Cold War have led to a revival of public interest in, and anxiety about, international law. Liberal international law is appealed to as offering a means of constraining power and as representing universal values. The “classic” is a vexed term in the work of William Carlos Williams. He uses the category to describe both the stale classicism of T. S. Eliot and Ezra Pound and, conversely, the authentic, “aberrant” classic of James Joyce and surrealism. Analyzing unpublished archival manuscripts alongside the posthumously published collection of essays, The Embodiment of Knowledge, I approach the classic through Williams's theories of pedagogy. Williams parodies and rejects academic modes of reading that cling to the “malignant rigidities” of (...) the past. Yet Paterson and The Embodiment also theorize the reader's interpretive power to disrupt any homogenizing conformity latent in the literary tradition. This dissonant hermeneutics can recuperate the classics and represents a form of resistance to a binary logic of past versus present, or European versus American literature. (shrink)

The 102 dedications composed by the sixteenth-century physician and polymath Conrad Gessner between 1541 and 1565 offer a rich trove of insight into many aspects of his particular career but also into the workings of the Republic of Letters more generally. Although Gessner never benefitted from a major patronage relationship and probably received limited financial support from his dedicatees, he nonetheless managed to publish a number of major works on his initiative, including folio volumes of philology, bibliography, and especially (...) expensive works of illustrated natural history. Crucial to Gessner’s success was his accumulation of smaller contributions in kind from a wide range of people who offered him hospitality or sent him information and specimens, manuscripts and images, which Gessner used in his publications. Gessner rewarded contributors not only by private expressions of thanks, but also in print, and especially visibly in his dedications. Gessner was also unusual in calling attention to the role of learned printers for his work, by composing dedications to them and by advertising that various of his publications were initiated by requests from printers or bequests of manuscripts by recently deceased scholars. Gessner thus used the high visibility of the printed dedication to invite further contributions from learned readers, bequests of unfinished manuscripts, and proposals from printers with which to fuel his remarkable productivity. L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

Le pape François se retrouve à la tête d’une Eglise confrontée à de grandes difficultés. Il a lancé et poursuivi des chantiers que son prédécesseur a eu du mal à faire avancer. Il a su se placer au centre des discussions essentielles de notre époque : la richesse et la pauvreté, l'équité et la justice, la transparence, la modernité, la mondialisation, le rôle de la femme, l’ouverture de la prêtrise aux femmes, la nature du mariage, l’accueil des divorcés remariés, les (...) tentations du pouvoir, les _relations avec l'islam, la lutte contre la pédophilie, les finances du Saint-Siège, _l’abolition du célibat ecclésiastique, _la gouvernance de l'Eglise, la redynamisation de la foi en Europe. Même si nous n’allons pas aborder tous ces thèmes, le pape pour sa part _n’a guère d’autres solutions que de poursuivre dans la route déjà empruntée pour une Église à géométrie variable. Au-delà de sa personne, il s’agit de l’Eglise et, surtout de l’accueille du Christ par notre société contemporaine dans sa diversité culturelle. Ce qui est frappant c’est de voir comment le Pape François catalyseur, conçoit son ministère à travers l’écoute des pasteurs qui ont eux-mêmes écouté le peuple. Il insiste souvent sur l’enjeu de la liberté de parole et de débat. D’où la place que nous avons à la riche culture africaine. (shrink)

Pindar’s songs were composed for men at play, but his poetry was political in its impulse and in its function. The men in question were rich and powerful, and their games were a display of exclusive class attributes, vicariously shared by lesser mortals who responded with gratitude and loyalty . Victories were counted as princely benefactions and laid up as city treasure like the wealth deposited in the treasuries at Delphi . Athletic victory was thus both a manifestation and (...) an enhancement of aristocratic domination, which meant that the poet who praised those who boxed and raced in pan-Hellenic games necessarily praised the social structure that depended on them.Pindar understood his political function and was proud of it—“I would consort with victors” .1 He believed in athletic contest as a model for all human life. He believed in the aristocratic system: “Inherited governance of cities lies properly with the nobility” . He believed also that praise poetry could regulate as well as laud that system, and he believed finally that such poetry was itself incorruptible. Games, song, and princely rulers were all parts of a single brilliant order, and this truth had a linguistic reflection, for the bit that tames a horse, the meter of a poetic line, and the moderation of a ruler were all called by the same name—metron. “Measure inheres in everything” . 1. This article, corresponding to a part of the restitution of a financed international research project between France, Brazil, Canada, Italy and Belgium, aims to offer a modelisation and qualitative evaluation of mediation care settings based on an original methodological tool that involves identifying the typical games at the foundations of creativity, following a multidisciplinary perspective. Therapeutic mediations are settings or devices organised around a “pliable medium”, often artistic, like painting, modeling, writing, ​and theatre, which are very widespread in institutional practices, (...) both in France and abroad. The scientific objectives of this research consist in a multi-disciplinary exploration (anthropology, criminology, neuroscience, clinical psychology) of the process of creative symbolisation understood as a process of transformation involving play. According to this orientation, play can be defined as a psychic process whereby a subjective experience can be explored with pleasure, and consequently symbolised and appropriated. Our fundamental and original hypothesis is that play is at the source of the creative process, conceived as a work of metabolisation by the psyche of playful experiences during the different stages of life. The review of the understanding of play in psychoanalysis, anthropology, criminology and neuroscience emphasises the richness of this model and the importance of reflecting on the typical games in the field of psychic care. A clinical example of treatment in a pictorial therapeutic mediation setting of a child with psychotic disorders makes it possible to identify a number of typical games as well as the modalities of interpretation of the therapists through play. These multidisciplinary studies lead to the presentation of a general table of typical games, and these first results highlight the richness of identifying typical games in clinical settings. Ultimately, the multidisciplinary approach shows the interest of the model of play in the evaluation of therapeutic mediation settings, with a convergence of the different disciplines emphasising the pertinence of this model. The scientific impact of this research overlaps with its societal impact, through the development of innovative tools for evaluating therapeutic mediations, in order to take account of the evolution of the different forms of social expression of psychic suffering. Elephants show a rich social organization and display a number of unusual traits. In this paper, we analyse reports collected over a thirty-five year period, describing behaviour that has the potential to reveal signs of empathic understanding. These include coalition formation, the offering of protection and comfort to others, retrieving and 'babysitting' calves, aiding individuals that would otherwise have difficulty in moving, and removing foreign objects attached to others. These records demonstrate that an elephant is capable of diagnosing animacy (...) and goal directedness, and is able to understand the physical competence, emotional state and intentions of others, when they differ from its own. We argue that an empathic understanding of others is the simplest explanation of these abilities, and discuss reasons why elephants appear to show empathy more than other non-primate species. (shrink)
